Anti-US Beef Actress Prevails in Court

Actress Kim Min-sun won a legal battle Tuesday, started by an American beef importer for an article she wrote two years ago on her private blog that allegedly exaggerated the risk of mad cow disease associated with U.S. beef.
In May 2008, when the country was trapped in heated debate over the resumption of U.S. beef imports and its association with mad cow disease, the actress said in the article, "I would gulp a cup of potassium cyanide rather than eat a piece of American beef infected with the disease."
As the comment drew media attention, an American beef importer in Seoul, A-Meat, filed a suit against the actress and five staff members of an investigative TV journal, PD Notebook, for interrupting its business by spreading what it called "groundless" information about the imported beef. The importer also claimed its bottom line was hit hard by her defamatory article.
But the Seoul Southern District Court Tuesday ruled the actress and the TV program were not liable for any damages to the importer.
Judge Kim Sung-gon said in the ruling, "Her article revealed no specific information associated with the plaintiff. So it cannot be seen that her article interrupted its business." The judge also acquitted the five TV producers, saying the program was wholly based on data they compiled in the belief that they were all scientifically grounded.
"Also, the program was to criticize the government for a deal with Washington allegedly endorsed in a cursory manner, not a specific company," the judge said.
Two years have passed since the social unrest, provoked by the resumption of U.S. beef imports without thorough restrictions to keep risky parts of American beef at bay, ended.
To quell enraged citizens, who took to major streets for three months, President Lee Myung-bak solicited for the U.S. government to modify the terms of the contract signed between the two parties, made public apologies and reshuffled the Cabinet.
But society is still divided and shows no immediate sign of mending the rift. Rather, what is left over from the unrest is still plaguing the administration by providing a ground for ideological showdowns between those in favor of the conservative administration and its opponents, levying a heavy political burden on President Lee, who is in the midst of his five-year presidency.
The latest controversy, associated with the beef scandal two years ago, resurfaced after a court ruling early this month that exonerated the five TV producers from defamation charges.
On Jan. 20, the Seoul Central District Court cleared them on defamation charges for allegedly wrongly portraying the actions of two senior state trade negotiators during the Seoul-Washington talks to resume U.S. beef imports in 2008.
The ruling provoked immediate condemnation from conservative activists and politicians, pressuring the head of the judiciary to step down, calling the verdict a decision based on ideological bias. Some overzealous activists even staged rallies in front of the home of the judge in charge of the case, calling for his resignation.
Liberal activists and politicians condemned their moves, describing a series of acts by their counterparts as politically motivated moves to sway the judiciary, whose independent operation is guaranteed under the Constitution.
Galvanized by the ruling, the ruling Grand National Party is now pushing a package of bills to tighten its grip on the judiciary, while opposition parties are trying to strike down the attempt.

Background: After the detection of two novel BSE forms designated H-type and L-type atypical BSE the question of the pathogenesis and the agent distribution of these two types in cattle was fully open. From initial studies of the brain pathology, it was already known that the anatomical distribution of L-type BSE differs from that of the classical type where the obex region in the brainstem always displays the highest PrPSc concentrations. In contrast in L-type BSE cases, the thalamus and frontal cortex regions showed the highest levels of the pathological prion protein, while the obex region was only weakly involved.
Methods:We performed intracranial inoculations of cattle (five and six per group) using 10%brainstemhomogenates of the two German H- and L-type atypical BSE isolates. The animals were inoculated under narcosis and then kept in a free-ranging stable under appropriate biosafety conditions.At least one animal per group was killed and sectioned in the preclinical stage and the remaining animals were kept until they developed clinical symptoms. The animals were examined for behavioural changes every four weeks throughout the experiment following a protocol that had been established during earlier BSE pathogenesis studies with classical BSE.
Results and Discussion: All animals of both groups developed clinical symptoms and had to be euthanized within 16 months. The clinical picture differed from that of classical BSE, as the earliest signs of illness were loss of body weight and depression. However, the animals later developed hind limb ataxia and hyperesthesia predominantly and the head. Analysis of brain samples from these animals confirmed the BSE infection and the atypical Western blot profile was maintained in all animals. Samples from these animals are now being examined in order to be able to describe the pathogenesis and agent distribution for these novel BSE types. Conclusions: A pilot study using a commercially avaialble BSE rapid test ELISA revealed an essential restriction of PrPSc to the central nervous system for both atypical BSE forms. A much more detailed analysis for PrPSc and infectivity is still ongoing.

An update on atypical BSE and other TSE in North America. Please remember, the typical U.K. c-BSE, the atypical l-BSE (BASE), and h-BSE have all been documented in North America, along with the typical scrapie's, and atypical Nor-98 Scrapie, and to date, 2 different strains of CWD, and also TME. All these TSE in different species have been rendered and feed to food producing animals for humans and animals in North America (TSE in cats and dogs ?), and that the trading of these TSEs via animals and products via the USA and Canada has been immense over the years, decades.

I propose that the current diagnostic criteria for human TSEs only enhances and helps the spreading of human TSE from the continued belief of the UKBSEnvCJD only theory in 2009. With all the science to date refuting it, to continue to validate this old myth, will only spread this TSE agent through a multitude of potential routes and sources i.e. consumption, medical i.e., surgical, blood, dental, endoscopy, optical, nutritional supplements, cosmetics etc.
Conclusion
I would like to submit a review of past CJD surveillance in the USA, and the urgent need to make all human TSE in the USA a reportable disease, in every state, of every age group, and to make this mandatory immediately without further delay. The ramifications of not doing so will only allow this agent to spread further in the medical, dental, surgical arena's. Restricting the reporting of CJD and or any human TSE is NOT scientific. Iatrogenic CJD knows NO age group, TSE knows no boundaries.
I propose as with Aguzzi, Asante, Collinge, Caughey, Deslys, Dormont, Gibbs, Gajdusek, Ironside, Manuelidis, Marsh, et al and many more, that the world of TSE Transmissible Spongiform Encephalopathy is far from an exact science, but there is enough proven science to date that this myth should be put to rest once and for all, and that we move forward with a new classification for human and animal TSE that would properly identify the infected species, the source species, and then the route.

I look forward to further transmission studies, and a true ENHANCED BSE/atypical BSE surveillance program put forth testing all cattle for human and animal consumption for 5 years. a surveillance program that uses the most sensitive TSE testing, and has the personnel that knows how to use them, and can be trusted. I look forward to a stringent mad cow feed ban being put forth, and then strictly enforced. we need a forced, not voluntary feed ban, an enhanced feed ban at that, especially excluding blood. we need some sort of animal traceability. no more excuses about privacy. if somebody is putting out a product that is killing folks and or has the potential to kill you, then everybody needs to know who they are, and where that product came from. same with hospitals, i think medical incidents in all states should be recorded, and made public, when it comes to something like a potential accidental transmission exposure event. so if someone is out there looking at a place to go have surgery done, if you have several hospitals having these type 'accidental exposure events', than you can go some place else. it only makes sense. somewhere along the road, the consumer lost control, and just had to take whatever they were given, and then charged these astronomical prices. some where along the line the consumer just lost interest, especially on a long incubating disease such as mad cow disease i.e. Transmissible Spongiform Encephalopathy. like i said before, there is much more to the mad cow story than bovines and eating a hamburger, we must start focusing on all TSE in all species. ...TSS

this is typical BSe. you here industry groups comment 'your more likely to get hit by a car than die from CJD'. well, maybe so, but my mother and many more did not die from getting hit by a car, they died from CJD, my mothers being the hvCJD (confirmed), and my neighbors mother died from CJD (confirmed). the UKBSEnvCJD _only_ theory is incorrect. there are more strains of mad cow than the UK BSE in beef to nvCJD in humans in the UK. The deception by the USDA, FDA, and the Bush administration about mad cow disease, CJD, and all Transmissible Spongiform Encephalopathy over the past 8 years have been outrageous, to a point of being criminal. I am vested in nothing, but the truth.

High Court Rules In Favor of PD Notebook
A high court ruled in favor of MBC TV's PD Notebook, Wednesday, in an appeal filed by 462 people who demanded compensation for psychological damage caused by the program's alleged distorted reporting on U.S. beef.
In September, 2008, 2,455 people filed a class action against MBC, the program directors and writers, demanding 2.5 billion won ($1.7 million) in compensation. However, only 462 appealed a lower court ruling.
The Seoul High Court said, "There is no explicit evidence that the program worked as a direct trigger for candlelit protests against the government. Neither is there causality between the program and damage claimed by the plaintiffs."
Still, it upheld the lower court ruling that information in the program may have been "partially inaccurate."
In April 2008, an episode of the program suggested that people who consume U.S. beef could contract the human form of "mad cow disease." The content enraged numerous citizens upset with a decision to resume American beef imports, resulting in tens of thousands of people taking to the streets of downtown Seou.l. calling for it to be reversed.

Preliminary test results indicate that a 22-year-old Portsmouth woman who died in April did not have an illness that has been associated with eating contaminated beef, a U.S. Department of Agriculture official said this week. "The epidemiologic characteristics of the illness and preliminary results of the neuropathologic testing of brain tissue obtained at autopsy indicate that the patient did not die of" a variant of Creutzfeldt-Jakob Disease (vCJD), which has been associated with mad cow disease, said Richard Raymond, USDA undersecretary for food safety. He was speaking Sunday to a group of Korean and American reporters in Washington. "The U.S. Centers for Disease Control and Prevention has just provided us with that information, and I felt it was important to share with you today," he told the group. The comment appears on a statement on the safety of the U.S. beef supply that is available on the USDA's Food Safety and Inspection Service Web site. Aretha Vinson died April 9 at Bon Secours Maryview Medical Center in Portsmouth. She had a degenerative brain condition that can be caused by a wide variety of things, and concerns were raised that she might have had vCJD. The state health department, CDC and the University of Virginia were involved in testing to determine the cause of death and whether it indicated a public health concern. "There's no threat to the general public," said Michelle Peregoy, a Virginia Department of Health spokeswoman. She would not say more, citing patient confidentiality issues. Virginia State University student Aretha Vinson has contracted a rare brain disorder called Creutzfeldt-Jakob Disease, a variant of Mad Cow Disease. Virginia state health officials are investigating how Vinson contracted the disease. Doctors suspect Vinson contracted the disease after having gastric bypass surgery, possibly from tainted medical instruments. Vinson's family says her health worsened after having gastric bypass surgery three months prior to the diagnosis. UPDATE: Vinson passed away at 5:30pm on Wednesday, April 9, 2008.

Comment 2006-2007 USA AND OIE POISONING GLOBE WITH BSE MRR POLICY
THE USA is in a most unique situation, one of unknown circumstances with human and animal TSE. THE USA has the most documented TSE in different species to date, with substrains growing in those species (BSE/BASE in cattle and CWD in deer and elk, there is evidence here with different strains), and we know that sheep scrapie has over 20 strains of the typical scrapie with atypical scrapie documented and also BSE is very likely to have passed to sheep. all of which have been rendered and fed back to animals for human and animal consumption, a frightening scenario. WE do not know the outcome, and to play with human life around the globe with the very likely TSE tainted products from the USA, in my opinion is like playing Russian roulette, of long duration, with potential long and enduring consequences, of which once done, cannot be undone. These are the facts as I have come to know through daily and extensive research of TSE over 9 years, since 12/14/97. I do not pretend to have all the answers, but i do know to continue to believe in the ukbsenvcjd only theory of transmission to humans of only this one strain from only this one TSE from only this one part of the globe, will only lead to further failures, and needless exposure to humans from all strains of TSE, and possibly many more needless deaths from TSE via a multitude of proven routes and sources via many studies with primates and rodents and other species.
MY personal belief, since you ask, is that not only the Canadian border, but the USA border, and the Mexican border should be sealed up tighter than a drum for exporting there TSE tainted products, until a validated, 100% sensitive test is available, and all animals for human and animal consumption are tested. all we are doing is the exact same thing the UK did with there mad cow poisoning when they exported it all over the globe, all the while knowing what they were doing. this BSE MRR policy is nothing more than a legal tool to do just exactly what the UK did, thanks to the OIE and GW, it's legal now. and they executed Saddam for poisoning ???

I lost my mother to hvCJD (Heidenhain Variant CJD). I would like to comment on the CDC's attempts to monitor the occurrence of emerging forms of CJD. Asante, Collinge et al [1] have reported that BSE transmission to the 129-methionine genotype can lead to an alternate phenotype that is indistinguishable from type 2 PrPSc, the commonest sporadic CJD. However, CJD and all human TSEs are not reportable nationally. CJD and all human TSEs must be made reportable in every state and internationally. I hope that the CDC does not continue to expect us to still believe that the 85%+ of all CJD cases which are sporadic are all spontaneous, without route/source. We have many TSEs in the USA in both animal and man. CWD in deer/elk is spreading rapidly and CWD does transmit to mink, ferret, cattle, and squirrel monkey by intracerebral inoculation. With the known incubation periods in other TSEs, oral transmission studies of CWD may take much longer. Every victim/family of CJD/TSEs should be asked about route and source of this agent. To prolong this will only spread the agent and needlessly expose others. In light of the findings of Asante and Collinge et al, there should be drastic measures to safeguard the medical and surgical arena from sporadic CJDs and all human TSEs. I only ponder how many sporadic CJDs in the USA are type 2 PrPSc?

To the Editor: In their Research Letter, Dr Gibbons and colleagues1 reported that the annual US death rate due to Creutzfeldt-Jakob disease (CJD) has been stable since 1985. These estimates, however, are based only on reported cases, and do not include misdiagnosed or preclinical cases. It seems to me that misdiagnosis alone would drastically change these figures. An unknown number of persons with a diagnosis of Alzheimer disease in fact may have CJD, although only a small number of these patients receive the postmortem examination necessary to make this diagnosis. Furthermore, only a few states have made CJD reportable. Human and animal transmissible spongiform encephalopathies should be reportable nationwide and internationally.

WHAT about atypical BSE TSE ??? Some atypical BSE i.e. the l-BSE is more virulent, and the data on h-BSE is still out, but we do know that h-BSE is capable of transmitting to humans. With an incubation period as such with human and animal TSE, the known transmission studies of confirmed transmission of different TSE, and all the unknowns still, I think it is absolutely asinine to even consider this. It's sad, and very concerning that man never learns from his mistakes.

High Court Rules In Favor of PD Notebook
A high court ruled in favor of MBC TV's PD Notebook, Wednesday, in an appeal filed by 462 people who demanded compensation for psychological damage caused by the program's alleged distorted reporting on U.S. beef.
In September, 2008, 2,455 people filed a class action against MBC, the program directors and writers, demanding 2.5 billion won ($1.7 million) in compensation. However, only 462 appealed a lower court ruling.
The Seoul High Court said, "There is no explicit evidence that the program worked as a direct trigger for candlelit protests against the government. Neither is there causality between the program and damage claimed by the plaintiffs."
Still, it upheld the lower court ruling that information in the program may have been "partially inaccurate."
In April 2008, an episode of the program suggested that people who consume U.S. beef could contract the human form of "mad cow disease." The content enraged numerous citizens upset with a decision to resume American beef imports, resulting in tens of thousands of people taking to the streets of downtown Seou.l. calling for it to be reversed.

Preliminary test results indicate that a 22-year-old Portsmouth woman who died in April did not have an illness that has been associated with eating contaminated beef, a U.S. Department of Agriculture official said this week. "The epidemiologic characteristics of the illness and preliminary results of the neuropathologic testing of brain tissue obtained at autopsy indicate that the patient did not die of" a variant of Creutzfeldt-Jakob Disease (vCJD), which has been associated with mad cow disease, said Richard Raymond, USDA undersecretary for food safety. He was speaking Sunday to a group of Korean and American reporters in Washington. "The U.S. Centers for Disease Control and Prevention has just provided us with that information, and I felt it was important to share with you today," he told the group. The comment appears on a statement on the safety of the U.S. beef supply that is available on the USDA's Food Safety and Inspection Service Web site. Aretha Vinson died April 9 at Bon Secours Maryview Medical Center in Portsmouth. She had a degenerative brain condition that can be caused by a wide variety of things, and concerns were raised that she might have had vCJD. The state health department, CDC and the University of Virginia were involved in testing to determine the cause of death and whether it indicated a public health concern. "There's no threat to the general public," said Michelle Peregoy, a Virginia Department of Health spokeswoman. She would not say more, citing patient confidentiality issues. Virginia State University student Aretha Vinson has contracted a rare brain disorder called Creutzfeldt-Jakob Disease, a variant of Mad Cow Disease. Virginia state health officials are investigating how Vinson contracted the disease. Doctors suspect Vinson contracted the disease after having gastric bypass surgery, possibly from tainted medical instruments. Vinson's family says her health worsened after having gastric bypass surgery three months prior to the diagnosis. UPDATE: Vinson passed away at 5:30pm on Wednesday, April 9, 2008.

Background: An update on atypical BSE and other TSE in North America. Please remember, the typical U.K. c-BSE, the atypical l-BSE (BASE), and h-BSE have all been documented in North America, along with the typical scrapie's, and atypical Nor-98 Scrapie, and to date, 2 different strains of CWD, and also TME. All these TSE in different species have been rendered and fed to food producing animals for humans and animals in North America (TSE in cats and dogs ?), and that the trading of these TSEs via animals and products via the USA and Canada has been immense over the years, decades.
Methods: 12 years independent research of available data
Results: I propose that the current diagnostic criteria for human TSEs only enhances and helps the spreading of human TSE from the continued belief of the UKBSEnvCJD only theory in 2009. With all the science to date refuting it, to continue to validate this old myth, will only spread this TSE agent through a multitude of potential routes and sources i.e. consumption, medical i.e., surgical, blood, dental, endoscopy, optical, nutritional supplements, cosmetics etc.
Conclusion: I would like to submit a review of past CJD surveillance in the USA, and the urgent need to make all human TSE in the USA a reportable disease, in every state, of every age group, and to make this mandatory immediately without further delay. The ramifications of not doing so will only allow this agent to spread further in the medical, dental, surgical arena's. Restricting the reporting of CJD and or any human TSE is NOT scientific. Iatrogenic CJD knows NO age group, TSE knows no boundaries. I propose as with Aguzzi, Asante, Collinge, Caughey, Deslys, Dormont, Gibbs, Gajdusek, Ironside, Manuelidis, Marsh, et al and many more, that the world of TSE Transmissible Spongiform Encephalopathy is far from an exact science, but there is enough proven science to date that this myth should be put to rest once and for all, and that we move forward with a new classification for human and animal TSE that would properly identify the infected species, the source species, and then the route.

Comment 2006-2007 USA AND OIE POISONING GLOBE WITH BSE MRR POLICY
THE USA is in a most unique situation, one of unknown circumstances with human and animal TSE. THE USA has the most documented TSE in different species to date, with substrains growing in those species (BSE/BASE in cattle and CWD in deer and elk, there is evidence here with different strains), and we know that sheep scrapie has over 20 strains of the typical scrapie with atypical scrapie documented and also BSE is very likely to have passed to sheep. all of which have been rendered and fed back to animals for human and animal consumption, a frightening scenario. WE do not know the outcome, and to play with human life around the globe with the very likely TSE tainted products from the USA, in my opinion is like playing Russian roulette, of long duration, with potential long and enduring consequences, of which once done, cannot be undone. These are the facts as I have come to know through daily and extensive research of TSE over 9 years, since 12/14/97. I do not pretend to have all the answers, but i do know to continue to believe in the ukbsenvcjd only theory of transmission to humans of only this one strain from only this one TSE from only this one part of the globe, will only lead to further failures, and needless exposure to humans from all strains of TSE, and possibly many more needless deaths from TSE via a multitude of proven routes and sources via many studies with primates and rodents and other species.
MY personal belief, since you ask, is that not only the Canadian border, but the USA border, and the Mexican border should be sealed up tighter than a drum for exporting there TSE tainted products, until a validated, 100% sensitive test is available, and all animals for human and animal consumption are tested. all we are doing is the exact same thing the UK did with there mad cow poisoning when they exported it all over the globe, all the while knowing what they were doing. this BSE MRR policy is nothing more than a legal tool to do just exactly what the UK did, thanks to the OIE and GW, it's legal now. and they executed Saddam for poisoning ???

I lost my mother to hvCJD (Heidenhain Variant CJD). I would like to comment on the CDC's attempts to monitor the occurrence of emerging forms of CJD. Asante, Collinge et al [1] have reported that BSE transmission to the 129-methionine genotype can lead to an alternate phenotype that is indistinguishable from type 2 PrPSc, the commonest sporadic CJD. However, CJD and all human TSEs are not reportable nationally. CJD and all human TSEs must be made reportable in every state and internationally. I hope that the CDC does not continue to expect us to still believe that the 85%+ of all CJD cases which are sporadic are all spontaneous, without route/source. We have many TSEs in the USA in both animal and man. CWD in deer/elk is spreading rapidly and CWD does transmit to mink, ferret, cattle, and squirrel monkey by intracerebral inoculation. With the known incubation periods in other TSEs, oral transmission studies of CWD may take much longer. Every victim/family of CJD/TSEs should be asked about route and source of this agent. To prolong this will only spread the agent and needlessly expose others. In light of the findings of Asante and Collinge et al, there should be drastic measures to safeguard the medical and surgical arena from sporadic CJDs and all human TSEs. I only ponder how many sporadic CJDs in the USA are type 2 PrPSc?

To the Editor: In their Research Letter, Dr Gibbons and colleagues1 reported that the annual US death rate due to Creutzfeldt-Jakob disease (CJD) has been stable since 1985. These estimates, however, are based only on reported cases, and do not include misdiagnosed or preclinical cases. It seems to me that misdiagnosis alone would drastically change these figures. An unknown number of persons with a diagnosis of Alzheimer disease in fact may have CJD, although only a small number of these patients receive the postmortem examination necessary to make this diagnosis. Furthermore, only a few states have made CJD reportable. Human and animal transmissible spongiform encephalopathies should be reportable nationwide and internationally.

WHAT about atypical BSE TSE ??? Some atypical BSE i.e. the l-BSE is more virulent, and the data on h-BSE is still out, but we do know that h-BSE is capable of transmitting to humans. With an incubation period as such with human and animal TSE, the known transmission studies of confirmed transmission of different TSE, and all the unknowns still, I think it is absolutely asinine to even consider this. It's sad, and very concerning that man never learns from his mistakes.

WASHINGTON, January 5, 2010 - The Office of the United States Trade Representative and the U.S. Department of Agriculture today released a statement regarding the decision by Taiwan's Legislative Yuan to bar import of some U.S. beef and beef products. The following statement is from Deputy United States Trade Representative Demetrios Marantis and Undersecretary for Farm and Foreign Agricultural Services Jim Miller:
"We are deeply disappointed with the decision by Taiwan's Legislative Yuan to amend the Food Sanitation Act (FSA) to unjustifiably bar the import of certain U.S. beef and beef products.
"As we noted in our statement on December 29, the FSA amendment's provisions do not have a basis in science and constitute a unilateral violation of a bilateral agreement concluded in good faith by the United States with Taiwan a little over two months ago. The protocol was negotiated on the basis of the guidelines laid out by the World Organization for Animal Health (the OIE), as well as the findings of Taiwan's own risk assessment, which concluded that all U.S. beef and beef products are safe.
"The decision by Taiwan authorities to place domestic politics over science raises serious concerns. This action will also undermine Taiwan's credibility as a responsible trading partner and will make it more challenging for us to conclude future agreements to expand and strengthen bilateral trade and economic ties.
"The decision to violate our bilateral agreement is particularly disappointing, as the United States has long been one of Taiwan's most important trade and investment partners, as well as the strongest supporter of Taiwan's active participation in the global trading system, including its membership in the World Trade Organization (WTO). In light of the continuing importance of our bilateral economic relationship, we urge Taiwan to honor its commitments and to implement the beef protocol as negotiated."
BACKGROUND
The United States has implemented a comprehensive set of measures, regulations, and practices that are science-based, consistent with the guidelines of the OIE for minimizing the risk posed by Bovine Spongiform Encephalopathy (BSE). The OIE is recognized by the WTO as the relevant standard-setting body for regulations relating to animal health. These measures allow us to assure consumers in the United States, Taiwan and elsewhere that U.S. beef and beef products - including offals and ground beef - are safe. Millions of American families enjoy these products every day.
In June 2007, the United States requested that Taiwan provide market expansion for all U.S. beef and beef products consistent with the OIE classification of the United States as a controlled-risk country. Since then, the United States has worked closely with Taiwan to provide all information necessary for Taiwan to fully evaluate these measures in the preparation of the Department of Health's final risk assessment, released by the Department of Health in January 2009, which determined that all U.S. beef and beef products are safe. In the interests of science-based trade with Taiwan, the United States has provided research, data, scientific experts, technical assistance, and detailed information regarding U.S. risk mitigation measures, as well as facilitated two on-site visits to major U.S. exporting beef establishments for Taiwan experts, all of which have underscored the safety of the relevant U.S. beef and beef products.
After over two years of extensive negotiations and scientific and technical exchanges, we concluded an agreement, the "Protocol of Bovine Spongiform Encephalopathy (BSE)-Related Measures for the Importation of Beef and Beef Products for Human Consumption from the Territory of the Authorities Represented by the American Institute in Taiwan (AIT)," on expanded market access for U.S. beef and beef products. The Protocol is science-based, consistent with the OIE guidelines, the domestic legal obligations of both sides, as well as the findings of Taiwan's own risk assessment. The Protocol thus provides further assurances that U.S. beef and beef products to be exported to Taiwan - which are the same products that are consumed by Americans at home - are safe.
Taiwan announced that the protocol would enter into force on November 2, 2009.
Under the terms of the Protocol, all tissues that are scientifically recognized as posing a risk of BSE, known as specified risk materials (SRMs), must be removed, and no SRMs or beef containing SRMs will be eligible for export to Taiwan. These tissues are tonsils and distal ileum from cattle of all ages and also the brain, eyes, spinal cord, skull, dorsal root ganglia, and vertebral column from cattle 30 months of age and older. This list excludes the vertebrae of the tail, the transverse processes of the thoracic and lumbar vertebrae, and the wings of the sacrum.
The Protocol is designed to both ensure human health and provide a clear and predictable commercial environment. The protocol specifies the actions that will be taken in response to instances of non-compliance that constitute food safety hazards, as well as to those that are unrelated to food safety. Taiwan will apply the same inspection procedures and border measures to U.S. beef imports that it applies to all imports from other countries.
The Protocol establishes a consultation mechanism under which both sides will have the opportunity to request consultations as needed to address any issues that may arise in the implementation of the Protocol.
While the Protocol allows trade in beef and beef products from cattle of any age, provided that SRM tissues are removed, the U.S. beef exporting industry has committed to voluntarily limit beef exports to Taiwan during a transitional period to products beef and beef products from cattle less than 30 months of age under a Quality Systems Assessment program verified by USDA.

Can anyone blame Taiwan for banning USA beef? I applaud Taiwan for standing up to the USA and their junk science, and trying to protect their consumers. The USA has been covering up mad cow disease for over a decade. The OIG and the GAO have proven, time and time again, the failures and flaws with the USA BSE surveillance, and then they hide behind the infamous triple firewall of the failed, partial and voluntary feed ban of August 4, 1997. This was nothing but ink on paper, it was never enforceable. nope, all the USA does is blame everything on Canada. what they really need to do is stand if front of a mirror and take a good look at themselves. The USDA's NSLP for over 4 years fed dead stock downer cows to our children all across the Nation. These are the most high risk cattle for mad cow disease and other dangerous pathogens. Comment 2006-2007 USA AND OIE POISONING GLOBE WITH BSE MRR POLICY
THE USA is in a most unique situation, one of unknown circumstances with human and animal TSE. THE USA has the most documented TSE in different species to date, with substrains growing in those species (BSE/BASE in cattle and CWD in deer and elk, there is evidence here with different strains), and we know that sheep scrapie has over 20 strains of the typical scrapie with atypical scrapie documented and also BSE is very likely to have passed to sheep. all of which have been rendered and fed back to animals for human and animal consumption, a frightening scenario. WE do not know the outcome, and to play with human life around the globe with the very likely TSE tainted products from the USA, in my opinion is like playing Russian roulette, of long duration, with potential long and enduring consequences, of which once done, cannot be undone. These are the facts as I have come to know through daily and extensive research of TSE over 9 years, since 12/14/97. I do not pretend to have all the answers, but i do know to continue to believe in the ukbsenvcjd only theory of transmission to humans of only this one strain from only this one TSE from only this one part of the globe, will only lead to further failures, and needless exposure to humans from all strains of TSE, and possibly many more needless deaths from TSE via a multitude of proven routes and sources via many studies with primates and rodents and other species.
MY personal belief, since you ask, is that not only the Canadian border, but the USA border, and the Mexican border should be sealed up tighter than a drum for exporting there TSE tainted products, until a validated, 100% sensitive test is available, and all animals for human and animal consumption are tested. all we are doing is the exact same thing the UK did with there mad cow poisoning when they exported it all over the globe, all the while knowing what they were doing. this BSE MRR policy is nothing more than a legal tool to do just exactly what the UK did, thanks to the OIE and GW, it's legal now. and they executed Saddam for poisoning ???

WASHINGTON, January 5, 2010 - The Office of the United States Trade Representative and the U.S. Department of Agriculture today released a statement regarding the decision by Taiwan's Legislative Yuan to bar import of some U.S. beef and beef products. The following statement is from Deputy United States Trade Representative Demetrios Marantis and Undersecretary for Farm and Foreign Agricultural Services Jim Miller:
"We are deeply disappointed with the decision by Taiwan's Legislative Yuan to amend the Food Sanitation Act (FSA) to unjustifiably bar the import of certain U.S. beef and beef products.
"As we noted in our statement on December 29, the FSA amendment's provisions do not have a basis in science and constitute a unilateral violation of a bilateral agreement concluded in good faith by the United States with Taiwan a little over two months ago. The protocol was negotiated on the basis of the guidelines laid out by the World Organization for Animal Health (the OIE), as well as the findings of Taiwan's own risk assessment, which concluded that all U.S. beef and beef products are safe.
"The decision by Taiwan authorities to place domestic politics over science raises serious concerns. This action will also undermine Taiwan's credibility as a responsible trading partner and will make it more challenging for us to conclude future agreements to expand and strengthen bilateral trade and economic ties.
"The decision to violate our bilateral agreement is particularly disappointing, as the United States has long been one of Taiwan's most important trade and investment partners, as well as the strongest supporter of Taiwan's active participation in the global trading system, including its membership in the World Trade Organization (WTO). In light of the continuing importance of our bilateral economic relationship, we urge Taiwan to honor its commitments and to implement the beef protocol as negotiated."
BACKGROUND
The United States has implemented a comprehensive set of measures, regulations, and practices that are science-based, consistent with the guidelines of the OIE for minimizing the risk posed by Bovine Spongiform Encephalopathy (BSE). The OIE is recognized by the WTO as the relevant standard-setting body for regulations relating to animal health. These measures allow us to assure consumers in the United States, Taiwan and elsewhere that U.S. beef and beef products - including offals and ground beef - are safe. Millions of American families enjoy these products every day.
In June 2007, the United States requested that Taiwan provide market expansion for all U.S. beef and beef products consistent with the OIE classification of the United States as a controlled-risk country. Since then, the United States has worked closely with Taiwan to provide all information necessary for Taiwan to fully evaluate these measures in the preparation of the Department of Health's final risk assessment, released by the Department of Health in January 2009, which determined that all U.S. beef and beef products are safe. In the interests of science-based trade with Taiwan, the United States has provided research, data, scientific experts, technical assistance, and detailed information regarding U.S. risk mitigation measures, as well as facilitated two on-site visits to major U.S. exporting beef establishments for Taiwan experts, all of which have underscored the safety of the relevant U.S. beef and beef products.
After over two years of extensive negotiations and scientific and technical exchanges, we concluded an agreement, the "Protocol of Bovine Spongiform Encephalopathy (BSE)-Related Measures for the Importation of Beef and Beef Products for Human Consumption from the Territory of the Authorities Represented by the American Institute in Taiwan (AIT)," on expanded market access for U.S. beef and beef products. The Protocol is science-based, consistent with the OIE guidelines, the domestic legal obligations of both sides, as well as the findings of Taiwan's own risk assessment. The Protocol thus provides further assurances that U.S. beef and beef products to be exported to Taiwan - which are the same products that are consumed by Americans at home - are safe.
Taiwan announced that the protocol would enter into force on November 2, 2009.
Under the terms of the Protocol, all tissues that are scientifically recognized as posing a risk of BSE, known as specified risk materials (SRMs), must be removed, and no SRMs or beef containing SRMs will be eligible for export to Taiwan. These tissues are tonsils and distal ileum from cattle of all ages and also the brain, eyes, spinal cord, skull, dorsal root ganglia, and vertebral column from cattle 30 months of age and older. This list excludes the vertebrae of the tail, the transverse processes of the thoracic and lumbar vertebrae, and the wings of the sacrum.
The Protocol is designed to both ensure human health and provide a clear and predictable commercial environment. The protocol specifies the actions that will be taken in response to instances of non-compliance that constitute food safety hazards, as well as to those that are unrelated to food safety. Taiwan will apply the same inspection procedures and border measures to U.S. beef imports that it applies to all imports from other countries.
The Protocol establishes a consultation mechanism under which both sides will have the opportunity to request consultations as needed to address any issues that may arise in the implementation of the Protocol.
While the Protocol allows trade in beef and beef products from cattle of any age, provided that SRM tissues are removed, the U.S. beef exporting industry has committed to voluntarily limit beef exports to Taiwan during a transitional period to products beef and beef products from cattle less than 30 months of age under a Quality Systems Assessment program verified by USDA.

Can anyone blame Taiwan for banning USA beef? I applaud Taiwan for standing up to the USA and their junk science, and trying to protect their consumers. The USA has been covering up mad cow disease for over a decade. The OIG and the GAO have proven, time and time again, the failures and flaws with the USA BSE surveillance, and then they hide behind the infamous triple firewall of the failed, partial and voluntary feed ban of August 4, 1997. This was nothing but ink on paper, it was never enforceable. nope, all the USA does is blame everything on Canada. what they really need to do is stand if front of a mirror and take a good look at themselves. The USDA's NSLP for over 4 years fed dead stock downer cows to our children all across the Nation. These are the most high risk cattle for mad cow disease and other dangerous pathogens. IF the USDA et al are willing to feed this crap to our Children, do you think for one second they would not feed it to the Honorable people of Taiwan? They MUST demand, TEST, TEST, TEST !!! The USA could test every cow for mad cow disease if they chose, the refuse because they know what they will find. ... in my opinion...TSS

Comment 2006-2007 USA AND OIE POISONING GLOBE WITH BSE MRR POLICY
THE USA is in a most unique situation, one of unknown circumstances with human and animal TSE. THE USA has the most documented TSE in different species to date, with substrains growing in those species (BSE/BASE in cattle and CWD in deer and elk, there is evidence here with different strains), and we know that sheep scrapie has over 20 strains of the typical scrapie with atypical scrapie documented and also BSE is very likely to have passed to sheep. all of which have been rendered and fed back to animals for human and animal consumption, a frightening scenario. WE do not know the outcome, and to play with human life around the globe with the very likely TSE tainted products from the USA, in my opinion is like playing Russian roulette, of long duration, with potential long and enduring consequences, of which once done, cannot be undone. These are the facts as I have come to know through daily and extensive research of TSE over 9 years, since 12/14/97. I do not pretend to have all the answers, but i do know to continue to believe in the ukbsenvcjd only theory of transmission to humans of only this one strain from only this one TSE from only this one part of the globe, will only lead to further failures, and needless exposure to humans from all strains of TSE, and possibly many more needless deaths from TSE via a multitude of proven routes and sources via many studies with primates and rodents and other species.
MY personal belief, since you ask, is that not only the Canadian border, but the USA border, and the Mexican border should be sealed up tighter than a drum for exporting there TSE tainted products, until a validated, 100% sensitive test is available, and all animals for human and animal consumption are tested. all we are doing is the exact same thing the UK did with there mad cow poisoning when they exported it all over the globe, all the while knowing what they were doing. this BSE MRR policy is nothing more than a legal tool to do just exactly what the UK did, thanks to the OIE and GW, it's legal now. and they executed Saddam for poisoning ???

TAIPEI - TAIWAN said on Tuesday it would resume a ban on certain US beef imports amid public concerns over mad cow disease.
Lawmakers agreed to amend a law on food health to ban imports of cow organs, minced beef and other high-risk items such as spines and eyes, said Lu Hsueh-chang, parliamentary whip of the ruling Kuomintang party.
The decision was to be finalised next month in a vote that would furthermore determine whether beef-on-the-bone should also be banned, he said. The move will partially overturn a decision by the health department to allow imports of US beef-on-the-bone and cow organs, which was met with a public outcry. ...snip...end

JOINT STATEMENT FROM USTR, USDA ON THE PROPOSED PASSAGE OF AN AMENDMENT TO TAIWAN'S FOOD SANITATION ACT
WASHINGTON, Dec. 29, 2009 - The Office of the United States Trade Representative and the U.S. Department of Agriculture today released a brief statement regarding the Taiwan Legislative Yuan's completion of initial steps toward passing an amendment to Taiwan's Food Sanitation Act that bars import of some U.S. beef and beef products. The following statement is from Deputy United States Trade Representative Demetrios Marantis and Undersecretary for Farm and Foreign Agricultural Services Jim Miller:
"We are deeply concerned and disappointed by reports that Taiwan's Legislative Yuan has taken initial steps toward the passage of an amendment to the Food Sanitation Act that contains provisions that would unjustifiably bar the import of certain U.S. beef and beef products.
"This amendment's provisions do not have a basis in science or fact and thus in no way serve to protect Taiwan's food supply. If passed, this amendment would represent a new barrier to U.S. beef exports to Taiwan, and would constitute a unilateral abrogation of a bilateral agreement concluded in good faith by the United States with Taiwan just two months ago. The Taiwan authorities should consider very carefully the impact that passage of the amendment in its current form would have on Taiwan's reputation as a reliable trading partner and responsible member of the international community. Science and facts - not politics or hyperbole - should govern our trade and economic relations.
"The United States has implemented a comprehensive set of measures, regulations, and practices that are science-based, consistent with the guidelines of the World Organization for Animal Health (OIE) for minimizing the risk posed by BSE. The OIE is recognized by the World Trade Organization (WTO) as the relevant standard-setting body for regulations relating to animal health. These measures allow us to ensure consumers in the United States, Taiwan and elsewhere that U.S. beef and beef products --including offals and ground beef -- are safe, and millions of American families enjoy these products every day.
"We have worked closely with Taiwan to provide all information necessary for Taiwan to fully evaluate these measures in the preparation of the Department of Health's final risk assessment, which determined that U.S. beef and beef products are safe. In the interests of science-based trade with Taiwan, the United States has provided research, data, scientific experts, technical assistance, as well as detailed information regarding U.S. risk mitigation measures, all of which have underscored the safety of the relevant U.S. beef and beef products.
"After over two years of extensive negotiations and scientific and technical exchanges, we concluded an agreement, the "Protocol of Bovine Spongiform Encephalopathy (BSE)-Related Measures for the Importation of Beef and Beef Products for Human Consumption from the Territory of the Authorities Represented by the American Institute in Taiwan (AIT)," on expanded market access for U.S. beef and beef products. The Protocol is science-based, consistent with the OIE guidelines, the domestic legal obligations of both sides, as well as the findings of Taiwan's own risk assessment. The Protocol thus provides further assurances that U.S. beef and beef products to be exported to Taiwan - which are the same products that are consumed by Americans at home - are safe.
"This is a serious matter that concerns us greatly and we are monitoring the legislative process very closely."

To better quantify the impact of foodborne diseases on health in the United States, we compiled and analyzed information from multiple surveillance systems and other sources. We estimate that foodborne diseases cause approximately 76 million illnesses, 325,000 hospitalizations, and 5,000 deaths in the United States each year. Known pathogens account for an estimated 14 million illnesses, 60,000 hospitalizations, and 1,800 deaths. Three pathogens, Salmonella, Listeria, and Toxoplasma, are responsible for 1,500 deaths each year, more than 75% of those caused by known pathogens, while unknown agents account for the remaining 62 million illnesses, 265,000 hospitalizations, and 3,200 deaths. Overall, foodborne diseases appear to cause more illnesses but fewer deaths than previously estimated.

Objectives: The main objective of this study was to determine the impact of transport and lairage on the isolation rate and the number of Escherichia coli O157 on cattle.
Materials: Ninety animals, divided into three groups (A, B, and C) of 30 animals each, were used in this study. Individual animals were tagged, and samples were collected from the hides and feces of each at a feedlot and again after slaughter. The carcass of each animal was also sampled. Samples were also collected from the feedlot pens, the sides and floors of the transport trucks, and abattoir holding pens. The isolation rate and the number of E. coli O157 were estimated using a combination of immunomagnetic separation and the Most Probable Number technique.
Results: Cattle hides were more likely to be contaminated with E. coli O157 at the feedlot (31%) than at the abattoir (4%). E. coli O157 was detected in 18% and 12% of cattle feces collected at the feedlot and after slaughter, respectively. E. coli O157 was isolated from truck floors (26%), truck sides (11%), abattoir pen rails (47%), and pen floors (42%). The mean count of E. coli O157 in positive feces was log10 1.17 and 2.37MPN/g at the feedlot and slaughter, respectively. A 3 log10 increase in the number of E. coli O157 was observed between the feedlot (2.66MPN/g) and slaughter (5.66MPN/g) in the feces of one animal in group B. E. coli O157 was isolated from the hide and carcass of this animal.
Conclusions: Transport and lairage did not lead to an increase in the number or isolation rate of E. coli O157 from cattle.
Applications: Intervention strategies for reducing E. coli O157 contamination of cattle carcasses should target mechanisms that limit the impact of animals shedding a high number throughout production and processing.

Report of the committee Evolutionary Trends of Salmonella enteritidis Linked to Subpopulation Biology and Virulence Attributes a Time Specific Paper was presented by Dr. J. Guard Bouldin, ARS-USDA. The complete text of the presentation is included in these proceedings at the end of this report. Dr. Bouldin reported that Salmonella enterica serovar enteritidis (S. Enteritidis) is currently the world’s leading cause of food borne salmonellosis. It is the only serotype out of over 1400 within Salmonella enterica I that contaminates the internal contents of the egg by vertical transmission from the reproductive tract of otherwise healthy hens. Epidemiological studies have shown that this exceptionally invasive pathogen with an unusual tissue tropism has a more clonal population structure than most other broad-host range Salmonella serotypes. Dr. Guard Bouldin presented research findings that showed how this egg tropism is likely to have occurred. FSIS Salmonella initiatives for meat, poultry, and processed egg products presentation was given by Daniel L. Engeljohn, Office of Policy, Program and Employee Development, FSIS. Dr. Engeljohn presented FSIS’s mission, its public health performance measures, policies on pathogen control including Salmonella. As the public health regulatory agency in USDA, FSIS is responsible for ensuring that the nation’s commercial supply of meat, poultry, and processed egg products are safe, wholesome, and correctly labeled and packaged www.fsis.usda.gov/about_fsis/index.asp. In FY07, FSIS had approximately 7,800 full-time inspectors that visited around 6,200 facilities. Processing establishments receive daily inspection, slaughter establishments receive daily inspection along with every animal afforded a critical inspection before slaughter.
FSIS inspected approximately 44 billion pounds of livestock, 57 billion pounds of poultry, 3.5 billion pounds of liquid egg product, 3.8 billion pounds of product reinspected at the border, and conducted about 8 million inspection procedures. He described preliminary surveillance data for 2007 and compared them with data for previous years. Salmonella incidence was the furthest from its national health target, suggesting that reaching this target will require new approaches.

DISCUSSION
Serotyping results are presented for 18,267 Salmonella isolates. This year 44 percent of the isolates were from clinical cases and 56 percent were from monitor samples, compared to 38 percent and 62 percent last year, repectively.1
Of the clinical isolates, 35 percent were of bovine origin and 32 percent were isolated from swine. Thirty-nine percent of the monitor samples were isolated from chickens and 12 percent were recovered from turkeys. A total of 253 serotypes were identified from isolates recovered from animals, their environment, or feed in 40 states and the District of Columbia. The 10 most common serotypes (Table 1) accounted for 58 percent of the total isolates reported. Table 2 lists the 10 most common serotypes by clinical role: those from clinical cases and those from monitor samples. Salmonella Typhimurium, S. Heidelberg, S. Cerro, S. Senftenberg and S. Montevideo are found in both lists. Salmonella Typhimurium was again the most frequently identified serotype from all sources and clinical roles. (Table 1) It was the most common serotype from clinical cases and the third most common serotype from monitor samples (Table 2). Salmonella Typhimurium was among the five most frequently identified serotypes isolated from chickens, swine, horse and dog/cat (Tables 3, 6, 7 and . Fourteen percent of all isolates, 22 percent of isolates from clinical cases, and 8 percent of isolates from monitor samples were identified as S. Typhimurium, compared to 13 percent, 21 percent, and 9 percent, respectively, last year.1 Fifty-one percent of the S. Typhimurium isolates were identified as S. Typhimurium var. Copenhagen this year, compared to 53 percent last year.1 The majority of S. Typhimurium isolates recovered from swine were S. Typhimurium var. Copenhagen (73 percent); whereas 37 percent of isolates of chicken origin were S. Typhimurium var. Copenhagen, and 19 percent of equine origin were S. Typhimurium var. Copenhagen. An untypable serotype 4,5,12:i:- decreased to 164 this year from 262 last year1 and 43 7 in 20062. Sixty-seven of these were isolated from chickens, 20 from cattle, and 25 from horses. This serotype is believed to be S. Typhimurium that has lost the ability to express the phase 2 flagellar antigen. Salmonella Newport was the seventh most frequently identified serotype from all sources (Table 1) and third in clinical cases. (Table 2). It was the fourth most common serotype from clinical cases in cattle (Table 5) and accounted for 6 percent of the isolates of bovine origin. Salmonella salmonella 494 Report of the comite Newport was the second most common serotype from clinical cases in horses (Table 7) and accounted for 5 percent of the isolates of equine origin. Four percent of the total isolates from all sources and all clinical roles were S. Newport, compared with 4 percent last year1, 5 percent in 20062, and 9 percent in 2005.3 The number of Salmonella Enteritidis isolated decreased this year to 551 isolates compared to 774 isolates last year. Fifty-four percent of the isolates were of chicken origin and it was the most frequently identified serotype from chicken clinical cases and the third most common serotype from chicken monitor samples (Table 5). Eleven different phage types were identified among the 329 S. Enteritidis isolates that were phage typed. The most frequently identified phage types were type 8 (54 percent), type 13 (13 percent), and type 23 (11 percent). Two percent were untypable, and 2 percent reacted, but did not conform (RDNC.) Fifteen different phage types were identified among 150 S. Typhimurium isolates that were phage typed. The most common phage types were DT104 and variants (67 percent) and U302 (9 percent). Five percent were untypable and 5 percent reacted, but did not conform.

To better quantify the impact of foodborne diseases on health in the United States, we compiled and analyzed information from multiple surveillance systems and other sources. We estimate that foodborne diseases cause approximately 76 million illnesses, 325,000 hospitalizations, and 5,000 deaths in the United States each year. Known pathogens account for an estimated 14 million illnesses, 60,000 hospitalizations, and 1,800 deaths. Three pathogens, Salmonella, Listeria, and Toxoplasma, are responsible for 1,500 deaths each year, more than 75% of those caused by known pathogens, while unknown agents account for the remaining 62 million illnesses, 265,000 hospitalizations, and 3,200 deaths. Overall, foodborne diseases appear to cause more illnesses but fewer deaths than previously estimated.

In addition to brain homogenates, we performed bioassays using irradiated faecal homogenates collected from infected mule deer by intracerebral inoculation into Tg(ElkPrP) mice. Irradiation was used to damage nucleic acids and inactivate bacteria and viruses with minimal effects on prion titres23; irradiation of the Elk1 CWD isolate did not diminish its titre when assayed in Tg(ElkPrP) mice (data not shown).

THE USA is in a most unique situation, one of unknown circumstances with human and animal TSE. THE USA has the most documented TSE in different species to date, with substrains growing in those species (BSE/BASE in cattle and CWD in deer and elk, there is evidence here with different strains), and we know that sheep scrapie has over 20 strains of the typical scrapie with atypical scrapie documented and also BSE is very likely to have passed to sheep. all of which have been rendered and fed back to animals for human and animal consumption, a frightening scenario. WE do not know the outcome, and to play with human life around the globe with the very likely TSE tainted products from the USA, in my opinion is like playing Russian roulette, of long duration, with potential long and enduring consequences, of which once done, cannot be undone. These are the facts as I have come to know through daily and extensive research of TSE over 9 years, since 12/14/97. I do not pretend to have all the answers, but i do know to continue to believe in the ukbsenvcjd only theory of transmission to humans of only this one strain from only this one TSE from only this one part of the globe, will only lead to further failures, and needless exposure to humans from all strains of TSE, and possibly many more needless deaths from TSE via a multitude of proven routes and sources via many studies with primates and rodents and other species.
MY personal belief, since you ask, is that not only the Canadian border, but the USA border, and the Mexican border should be sealed up tighter than a drum for exporting there TSE tainted products, until a validated, 100% sensitive test is available, and all animals for human and animal consumption are tested. all we are doing is the exact same thing the UK did with there mad cow poisoning when they exported it all over the globe, all the while knowing what they were doing. this BSE MRR policy is nothing more than a legal tool to do just exactly what the UK did, thanks to the OIE and GW, it's legal now. and they executed Saddam for poisoning ???

Lawmakers agreed to amend a law on food health to ban imports of cow organs, minced beef and other high-risk items such as spines and eyes, said Lu Hsueh-chang, parliamentary whip of the ruling Kuomintang party.
The decision was to be finalised next month in a vote that would furthermore determine whether beef-on-the-bone should also be banned, he said. The move will partially overturn a decision by the health department to allow imports of US beef-on-the-bone and cow organs, which was met with a public outcry. ...snip...end

JOINT STATEMENT FROM USTR, USDA ON THE PROPOSED PASSAGE OF AN AMENDMENT TO TAIWAN'S FOOD SANITATION ACT
WASHINGTON, Dec. 29, 2009 - The Office of the United States Trade Representative and the U.S. Department of Agriculture today released a brief statement regarding the Taiwan Legislative Yuan's completion of initial steps toward passing an amendment to Taiwan's Food Sanitation Act that bars import of some U.S. beef and beef products. The following statement is from Deputy United States Trade Representative Demetrios Marantis and Undersecretary for Farm and Foreign Agricultural Services Jim Miller:
"We are deeply concerned and disappointed by reports that Taiwan's Legislative Yuan has taken initial steps toward the passage of an amendment to the Food Sanitation Act that contains provisions that would unjustifiably bar the import of certain U.S. beef and beef products.
"This amendment's provisions do not have a basis in science or fact and thus in no way serve to protect Taiwan's food supply. If passed, this amendment would represent a new barrier to U.S. beef exports to Taiwan, and would constitute a unilateral abrogation of a bilateral agreement concluded in good faith by the United States with Taiwan just two months ago. The Taiwan authorities should consider very carefully the impact that passage of the amendment in its current form would have on Taiwan's reputation as a reliable trading partner and responsible member of the international community. Science and facts - not politics or hyperbole - should govern our trade and economic relations.
"The United States has implemented a comprehensive set of measures, regulations, and practices that are science-based, consistent with the guidelines of the World Organization for Animal Health (OIE) for minimizing the risk posed by BSE. The OIE is recognized by the World Trade Organization (WTO) as the relevant standard-setting body for regulations relating to animal health. These measures allow us to ensure consumers in the United States, Taiwan and elsewhere that U.S. beef and beef products --including offals and ground beef -- are safe, and millions of American families enjoy these products every day.
"We have worked closely with Taiwan to provide all information necessary for Taiwan to fully evaluate these measures in the preparation of the Department of Health's final risk assessment, which determined that U.S. beef and beef products are safe. In the interests of science-based trade with Taiwan, the United States has provided research, data, scientific experts, technical assistance, as well as detailed information regarding U.S. risk mitigation measures, all of which have underscored the safety of the relevant U.S. beef and beef products.
"After over two years of extensive negotiations and scientific and technical exchanges, we concluded an agreement, the "Protocol of Bovine Spongiform Encephalopathy (BSE)-Related Measures for the Importation of Beef and Beef Products for Human Consumption from the Territory of the Authorities Represented by the American Institute in Taiwan (AIT)," on expanded market access for U.S. beef and beef products. The Protocol is science-based, consistent with the OIE guidelines, the domestic legal obligations of both sides, as well as the findings of Taiwan's own risk assessment. The Protocol thus provides further assurances that U.S. beef and beef products to be exported to Taiwan - which are the same products that are consumed by Americans at home - are safe.
"This is a serious matter that concerns us greatly and we are monitoring the legislative process very closely."

To better quantify the impact of foodborne diseases on health in the United States, we compiled and analyzed information from multiple surveillance systems and other sources. We estimate that foodborne diseases cause approximately 76 million illnesses, 325,000 hospitalizations, and 5,000 deaths in the United States each year. Known pathogens account for an estimated 14 million illnesses, 60,000 hospitalizations, and 1,800 deaths. Three pathogens, Salmonella, Listeria, and Toxoplasma, are responsible for 1,500 deaths each year, more than 75% of those caused by known pathogens, while unknown agents account for the remaining 62 million illnesses, 265,000 hospitalizations, and 3,200 deaths. Overall, foodborne diseases appear to cause more illnesses but fewer deaths than previously estimated.

Objectives: The main objective of this study was to determine the impact of transport and lairage on the isolation rate and the number of Escherichia coli O157 on cattle.
Materials: Ninety animals, divided into three groups (A, B, and C) of 30 animals each, were used in this study. Individual animals were tagged, and samples were collected from the hides and feces of each at a feedlot and again after slaughter. The carcass of each animal was also sampled. Samples were also collected from the feedlot pens, the sides and floors of the transport trucks, and abattoir holding pens. The isolation rate and the number of E. coli O157 were estimated using a combination of immunomagnetic separation and the Most Probable Number technique.
Results: Cattle hides were more likely to be contaminated with E. coli O157 at the feedlot (31%) than at the abattoir (4%). E. coli O157 was detected in 18% and 12% of cattle feces collected at the feedlot and after slaughter, respectively. E. coli O157 was isolated from truck floors (26%), truck sides (11%), abattoir pen rails (47%), and pen floors (42%). The mean count of E. coli O157 in positive feces was log10 1.17 and 2.37MPN/g at the feedlot and slaughter, respectively. A 3 log10 increase in the number of E. coli O157 was observed between the feedlot (2.66MPN/g) and slaughter (5.66MPN/g) in the feces of one animal in group B. E. coli O157 was isolated from the hide and carcass of this animal.
Conclusions: Transport and lairage did not lead to an increase in the number or isolation rate of E. coli O157 from cattle.
Applications: Intervention strategies for reducing E. coli O157 contamination of cattle carcasses should target mechanisms that limit the impact of animals shedding a high number throughout production and processing.

E. coli O157:H7 is a potentially deadly bacterium that can cause bloody diarrhea, dehydration, and in the most severe cases, kidney failure. FSIS routinely conducts recall effectiveness checks to verify recalling firms notify their customers of the recall and that steps are taken to make certain that the product is no longer available to consumers. FSIS advises all consumers to safely prepare their raw meat products, including fresh and frozen, and only consume ground beef or ground beef patties that have been cooked to a temperature of 160° F. The only way to be sure ground beef is cooked to a high enough temperature to kill harmful bacteria is to use a food thermometer to measure the internal temperature. Report of the committee Evolutionary Trends of Salmonella enteritidis Linked to Subpopulation Biology and Virulence Attributes a Time Specific Paper was presented by Dr. J. Guard Bouldin, ARS-USDA. The complete text of the presentation is included in these proceedings at the end of this report. Dr. Bouldin reported that Salmonella enterica serovar enteritidis (S. Enteritidis) is currently the world’s leading cause of food borne salmonellosis. It is the only serotype out of over 1400 within Salmonella enterica I that contaminates the internal contents of the egg by vertical transmission from the reproductive tract of otherwise healthy hens. Epidemiological studies have shown that this exceptionally invasive pathogen with an unusual tissue tropism has a more clonal population structure than most other broad-host range Salmonella serotypes. Dr. Guard Bouldin presented research findings that showed how this egg tropism is likely to have occurred. FSIS Salmonella initiatives for meat, poultry, and processed egg products presentation was given by Daniel L. Engeljohn, Office of Policy, Program and Employee Development, FSIS. Dr. Engeljohn presented FSIS’s mission, its public health performance measures, policies on pathogen control including Salmonella. As the public health regulatory agency in USDA, FSIS is responsible for ensuring that the nation’s commercial supply of meat, poultry, and processed egg products are safe, wholesome, and correctly labeled and packaged www.fsis.usda.gov/about_fsis/index.asp. In FY07, FSIS had approximately 7,800 full-time inspectors that visited around 6,200 facilities. Processing establishments receive daily inspection, slaughter establishments receive daily inspection along with every animal afforded a critical inspection before slaughter.
FSIS inspected approximately 44 billion pounds of livestock, 57 billion pounds of poultry, 3.5 billion pounds of liquid egg product, 3.8 billion pounds of product reinspected at the border, and conducted about 8 million inspection procedures. He described preliminary surveillance data for 2007 and compared them with data for previous years. In 2007, the estimated incidence of infections caused by Campylobacter, Listeria, Shiga toxin-producing Escherichia coli O157 (STEC O157), Salmonella, Shigella, Vibrio, and Yersinia did not change significantly, and Cryptosporidium infections increased compared with 2004--2006. Progress toward the targets for Healthy People 2010 national health objectives and targets regarding the incidence of foodborne infections occurred before 2004; however, none of the targets were reached in 2007. Salmonella incidence was the furthest from its national health target, suggesting that reaching this target will require new approaches.

DISCUSSION
Serotyping results are presented for 18,267 Salmonella isolates. This year 44 percent of the isolates were from clinical cases and 56 percent were from monitor samples, compared to 38 percent and 62 percent last year, repectively.1
Of the clinical isolates, 35 percent were of bovine origin and 32 percent were isolated from swine. Thirty-nine percent of the monitor samples were isolated from chickens and 12 percent were recovered from turkeys. A total of 253 serotypes were identified from isolates recovered from animals, their environment, or feed in 40 states and the District of Columbia. The 10 most common serotypes (Table 1) accounted for 58 percent of the total isolates reported. Table 2 lists the 10 most common serotypes by clinical role: those from clinical cases and those from monitor samples. Salmonella Typhimurium, S. Heidelberg, S. Cerro, S. Senftenberg and S. Montevideo are found in both lists. Salmonella Typhimurium was again the most frequently identified serotype from all sources and clinical roles. (Table 1) It was the most common serotype from clinical cases and the third most common serotype from monitor samples (Table 2). Salmonella Typhimurium was among the five most frequently identified serotypes isolated from chickens, swine, horse and dog/cat (Tables 3, 6, 7 and . Fourteen percent of all isolates, 22 percent of isolates from clinical cases, and 8 percent of isolates from monitor samples were identified as S. Typhimurium, compared to 13 percent, 21 percent, and 9 percent, respectively, last year.1 Fifty-one percent of the S. Typhimurium isolates were identified as S. Typhimurium var. Copenhagen this year, compared to 53 percent last year.1 The majority of S. Typhimurium isolates recovered from swine were S. Typhimurium var. Copenhagen (73 percent); whereas 37 percent of isolates of chicken origin were S. Typhimurium var. Copenhagen, and 19 percent of equine origin were S. Typhimurium var. Copenhagen. An untypable serotype 4,5,12:i:- decreased to 164 this year from 262 last year1 and 43 7 in 20062. Sixty-seven of these were isolated from chickens, 20 from cattle, and 25 from horses. This serotype is believed to be S. Typhimurium that has lost the ability to express the phase 2 flagellar antigen. Salmonella Newport was the seventh most frequently identified serotype from all sources (Table 1) and third in clinical cases. (Table 2). It was the fourth most common serotype from clinical cases in cattle (Table 5) and accounted for 6 percent of the isolates of bovine origin. Salmonella salmonella 494 Report of the comite Newport was the second most common serotype from clinical cases in horses (Table 7) and accounted for 5 percent of the isolates of equine origin. Four percent of the total isolates from all sources and all clinical roles were S. Newport, compared with 4 percent last year1, 5 percent in 20062, and 9 percent in 2005.3 The number of Salmonella Enteritidis isolated decreased this year to 551 isolates compared to 774 isolates last year. Fifty-four percent of the isolates were of chicken origin and it was the most frequently identified serotype from chicken clinical cases and the third most common serotype from chicken monitor samples (Table 5). Eleven different phage types were identified among the 329 S. Enteritidis isolates that were phage typed. The most frequently identified phage types were type 8 (54 percent), type 13 (13 percent), and type 23 (11 percent). Two percent were untypable, and 2 percent reacted, but did not conform (RDNC.) Fifteen different phage types were identified among 150 S. Typhimurium isolates that were phage typed. The most common phage types were DT104 and variants (67 percent) and U302 (9 percent). Five percent were untypable and 5 percent reacted, but did not conform.

To better quantify the impact of foodborne diseases on health in the United States, we compiled and analyzed information from multiple surveillance systems and other sources. We estimate that foodborne diseases cause approximately 76 million illnesses, 325,000 hospitalizations, and 5,000 deaths in the United States each year. Known pathogens account for an estimated 14 million illnesses, 60,000 hospitalizations, and 1,800 deaths. Three pathogens, Salmonella, Listeria, and Toxoplasma, are responsible for 1,500 deaths each year, more than 75% of those caused by known pathogens, while unknown agents account for the remaining 62 million illnesses, 265,000 hospitalizations, and 3,200 deaths. Overall, foodborne diseases appear to cause more illnesses but fewer deaths than previously estimated.

In addition to brain homogenates, we performed bioassays using irradiated faecal homogenates collected from infected mule deer by intracerebral inoculation into Tg(ElkPrP) mice. Comment 2006-2007 USA AND OIE POISONING GLOBE WITH BSE MRR POLICY
THE USA is in a most unique situation, one of unknown circumstances with human and animal TSE. THE USA has the most documented TSE in different species to date, with substrains growing in those species (BSE/BASE in cattle and CWD in deer and elk, there is evidence here with different strains), and we know that sheep scrapie has over 20 strains of the typical scrapie with atypical scrapie documented and also BSE is very likely to have passed to sheep. all of which have been rendered and fed back to animals for human and animal consumption, a frightening scenario. WE do not know the outcome, and to play with human life around the globe with the very likely TSE tainted products from the USA, in my opinion is like playing Russian roulette, of long duration, with potential long and enduring consequences, of which once done, cannot be undone. These are the facts as I have come to know through daily and extensive research of TSE over 9 years, since 12/14/97. I do not pretend to have all the answers, but i do know to continue to believe in the ukbsenvcjd only theory of transmission to humans of only this one strain from only this one TSE from only this one part of the globe, will only lead to further failures, and needless exposure to humans from all strains of TSE, and possibly many more needless deaths from TSE via a multitude of proven routes and sources via many studies with primates and rodents and other species.
MY personal belief, since you ask, is that not only the Canadian border, but the USA border, and the Mexican border should be sealed up tighter than a drum for exporting there TSE tainted products, until a validated, 100% sensitive test is available, and all animals for human and animal consumption are tested. all we are doing is the exact same thing the UK did with there mad cow poisoning when they exported it all over the globe, all the while knowing what they were doing. this BSE MRR policy is nothing more than a legal tool to do just exactly what the UK did, thanks to the OIE and GW, it's legal now. and they executed Saddam for poisoning ???
